Active Applications
Annexure A
ANNEXURE A - GROUNDS OF OBJECTION
1. The application does not relax Item 137 of the DMS; it removes the entire requirement of 20 parking bays, shifting all parking demand onto public streets. This is not a departure but a removal of the parking standard in its entirety.
2. The existing on-site parking bays are actively used by patrons of The Green Room restaurant, Good Riddance coffee shop, and the estate agency. Their removal will displace vehicles onto Huskisson Way and surrounding residential streets, creating congestion and safety hazards.
3. Kommetjie is not served by rail, MyCiTi trunk routes, or any PT1/PT2 public transport corridor. Residents, visitors, and staff arrive overwhelmingly by private vehicle. The DMS parking requirements exist precisely for such areas.
4. Under section 99(3) of the MPBL, the proposed departure has unacceptable impacts on:
- Traffic flow and parking availability on Huskisson Way and adjacent streets
- Pedestrian safety, particularly for children walking to the beach
- Compatibility with surrounding low-density residential uses
- Access for emergency vehicles and service deliveries
5. The application notice does not describe the nature, scale, floor area, or intended operation of the redeveloped building. Affected parties cannot comment meaningfully on a proposal that has not been disclosed.
6. No condition can adequately mitigate the provision of zero on-site parking bays. Approval would set an undesirable precedent for future applications in Kommetjie and similar low-density coastal villages.
RECOMMENDATION: The application should be refused in its entirety. Should the City be minded to approve any reduction, it must first require the full development proposal and an independent parking and traffic impact assessment covering weekday, weekend, and peak-season demand.
